Rep Porter 7/9/2019 letter to EPA on FOIA Rule
Representative Katie Porter (D-CA) wrote to the Environmental Protection Agency (EPA) on July 9, 2019, to raise concerns that the agency issued a final rule updating its Freedom of Information Act regulations without first posting a public notice or seeking public comment. Porter noted that the EPA’s use of the “good cause exception” to skip these normal steps in the rulemaking process appears to be inappropriate, and she urged the agency to open the rule to public comment before finalizing it.
