Host Maren Machles: Last time on Bad Watchdog...

Then-United States Senator Patrick Leahy (D-VT): Our nation’s history has been marred by the violent, deadly acts of extremists pushing a range of hateful white supremacist ideologies. 

United States Senator Richard Shelby (R-AL): Domestic violent extremists threaten the rule of law, but so too does turning a blind eye to the flood of illegal immigration at our southern border. 

Then-President George W. Bush: Today, our fellow citizens, our way of life, our very freedom came under attack in a series of deliberate and deadly terrorist acts.

Berto Hernandez: Our teachers, I remember them turning on the television and just playing this on repeat. Right after that, like we began hearing things about DHS and what that was.

Criminologist and domestic terrorism expert Alejandro Beutel: most of these people who are being rounded up weren’t the hardened criminals per se. They were the easy targets who could fulfill quotas.

Former DHS intelligence analyst Daryl Johnson: We’re sending out this prescient warning of this, you know, change in the threat landscape from al Qaida and international terrorists to more homegrown domestic terrorists. 

Berto Hernandez: He would not stop pointing at me with a gun and he would not answer me to me who he was. And then he came back, and I saw, like, the little ICE insignia, and then I knew, I was like, “Oh, shit.”

Maren: When we last left Berto, they described being pulled over by ICE, assaulted, and zip tied. 

Berto Hernandez: He was like, “Are you Humberto Hernandez?” And I’m like, “Yes.” And then he’s like, “We are with ICE.” And that’s when they told me, they gave me like the whole spiel. And like, if I had been here and I’m like, I’m not answering any of those things unless I have a lawyer present.

And that was like the one thing that I remember my aunt always saying that I never sign anything. And through that moment of panic, anxiety, and fear, I remember that. And I think that was one of the things that like actually kept me here.

Maren: First, they were taken to a facility in San Bernardino.

Berto Hernandez: I was isolated from everyone and then I got to talk to, like, the officer that assaulted me.

And he was like, “Oh, I’m sorry I had to do that.” And I’m like, “Okay, like, really?” And then he put this form in front of me. He’s like, “But if you sign here, you can be in Mexico, uh, today, tonight.” 

So I was like trying to make sense of what was happening.

Maren: We asked Berto if they ever filed a complaint against the officer, but they said no, because they were in such a state of distress. Berto said that this officer told them if they didn’t sign the papers, they were going to end up in an ICE facility and would have to appear in front of a judge. 

Berto Hernandez: And I was like, “Yeah, I wanna see a judge. I don’t know you. I don’t know what your intentions are.”

Maren: By around 5 p.m., Berto said they were transported to an immigration detention facility. 

Berto Hernandez: They chained my wrist to my waist. And then they chained my feet, the ankles of my feet to my waist so I couldn’t move. 

Even walking was really, really hard. And I just remember feeling so helpless.

Maren: This is a podcast about finding the truth and holding the powerful accountable. What happens to people who are thrown into the Department of Homeland Security’s detention facilities, with the presumption that they may be national security threats? This season, we dig into POGO’s exclusive investigations uncovering the agency’s treatment of people in detention — all justified in the name of homeland security, and all overshadowing the most dangerous threat: far-right violent extremists.

On this episode of Bad Watchdog, we’ll learn about how anti-terrorism laws from the ’90s bolstered the use of immigration detention, and we’ll hear from one of POGO’s investigators, Nick Schwellenbach, about the use of solitary confinement in ICE detention, and one immigrant detention center with a particularly bad record.

Episode Two: The Hole

Professor and author César Cuauhtémoc García Hernández: As soon as the federal government started deciding that some people, uh, were to be kept out of the United States and others could be allowed into the United States, we had to figure out who falls into which of these categories.

Maren: This is César Cuauhtémoc García Hernández. He’s a law professor at The Ohio State University and author of several books on immigration law, including one primarily focused on detention. He’s helping me understand the context of how ICE detention centers emerged and became an integral part of the Department of Homeland Security’s mission. 

Immigration detention is a relatively new thing in our nation’s history and it’s evolved over the years. It’s been around since the late 19th century, when Congress passed the Chinese Exclusion Act of 1882.

César Cuauhtémoc García Hernández: Chinese uh, prospective migrants would literally be held on ships and inspectors, customs officials, would, would try to, would go on board and try to figure out, “Okay, are we gonna let you land or, or not let you land?” The shipping companies, they eventually negotiated an agreement by which they would put up these individuals onshore and that’s essentially the first, uh, immigration detention facilities onshore.

Places like Ellis Island, famous for being the site of welcome to generations of newcomers. And it was certainly that, but it was also one of the first immigration prisons in the history of the United States.

Maren: César says that the use of immigration detention started to ramp down in the mid-20th century, but then ramped back up with the war on drugs in the ’80s and ’90s and exploded after the formation of DHS. 

In order to understand how immigration got so wrapped up with threats of terror in the US and how detention became integral to the immigration system, we need to run through two major events in the ’90s: the World Trade Center bombing and the Oklahoma City bombing. We’ve previously talked about the Oklahoma City bombing, but this time we’re going to look a little closer at how it shaped the conversation around terrorism today. 

On February 26, 1993, there was a bombing of the World Trade Center, killing six people and causing over a thousand injuries. 

WKYC anchor: It’s official. A bomb caused the deadly explosion at the World Trade Center. The World Trade Center will be closed for at least a week, and the investigation into who planted the bomb and why could take two to three months

Maren: The group of men later convicted for the terrorist attack were immigrants. And Ramzi Yousef, who was later deemed the organizer and mastermind behind the attack, had asked for asylum when he got here in 1992. As a result, in discussions about how to prevent another terrorist attack, immigration became central.

Then-Representative Chuck Schumer (D-NY): We must regard the terrorism at the World Trade Center as a wake-up call,  as a shot across the bow importuning us to act.

Maren: This is then-Representative Chuck Schumer, back when he was a representative from New York City’s outer boroughs. Here, he’s chairing the House Judiciary Subcommittee on Crime and Criminal Justice. And the subcommittee is holding a hearing on the investigation of the World Trade Center Bombing a little over a week after the attack.

Chuck Schumer: We are justifiably proud of our free and open society. We do not wanna close borders and establish draconian security measures on every street corner in our society. But surely there are steps between a secure but completely closed state and a totally open but dangerously vulnerable society.

Maren: And a few months after the attack, the Senate Judiciary Subcommittee on Immigration and Refugee Affairs held a hearing on US immigration policy, pointing to the World Trade Center bombing as an instance where terrorists abused the US immigration system. Here’s then-Senator Ted Kennedy.

United States Senator Edward Kennedy (D-MA): Our immigration laws and procedures are being overwhelmed by applicants for asylum, many of whom are making fraudulent claims, and some of whom are terrorists.

Maren: Here’s then-President Bill Clinton in January of 1995, giving his State of the Union address.

Then-President Bill Clinton: All Americans, not only in the States most heavily affected, but in every place in this country, are rightly disturbed by the large numbers of illegal aliens entering our country. That’s why our administration has moved aggressively to secure our borders more by hiring a record number of new border guards. 

Maren: Less than three months after that speech, another bomb went off — but this time it was terrorist attack from a far-right violent extremist. 

NBC anchor: A massive car bomb exploded outside of a large federal building in downtown Oklahoma City. Shattering that building, killing children, killing federal employees, military men, and civilians.

Maren: Two years after the World Trade Center bombing, on April 19, 1995, there was another bombing of a federal building, in Oklahoma City, killing 168 people, including 19 children. César says that the immigration status of the World Trade Center terrorist, Ramzi Yousef, colored the discussion around who could be responsible for this even more deadly attack. 

César Cuauhtémoc García Hernández: In the aftermath of the horrible bombing of the federal building in Oklahoma City, politicians immediately latched on to the idea that this must have been perpetrated by foreigners, by migrants, and specifically by Arab or Muslim migrants. So it turns out that that was not anything but the truth.

Maren: Timothy McVeigh, a veteran with connections to the KKK, was behind the terrorist attack. Research shows that McVeigh at one point became a member of the KKK, and people from his past said he was racist.

NBC anchor: It was the worst terrorist act in American history and Timothy McVeigh could now be sentenced to death.

Maren: In May 2001, while on death row, McVeigh made letters he wrote describing his motives public. According to the journalist he shared the letters with, he names events where federal law enforcement raids had ended violently, a lot like Waco, which was almost exactly two years prior, as inspiration for the attack. Remember, last episode I explained how both anti-government extremism and white supremacist extremism fall under the umbrella of far-right extremism. 

César Cuauhtémoc García Hernández: These were native-born white men who perpetrated this mass murder. And yet the reality of that tragic event in Oklahoma City did not do anything to alter the political trajectory that the country was already on, and that this event just pushed further along.

Maren: In response to the Oklahoma City bombing, a bipartisan bill is introduced. It’s called the Anti-terrorism and Effective Death Penalty Act of 1996. And you can hear over and over again that despite the fact that the terrorist was a U.S. citizen, members of Congress are arguing that this anti-terrorism act must include immigration reforms as well. Here’s then-Republican Representative Bill McCollum.

Then-United States Representative Bill McCollum (R-FL): Oftentimes, we find that terrorists, or would-be terrorists are criminal aliens, and we’re not deporting them in a proper fashion. We need to kick these people outta the country and have the procedures to do that.

Maren: And here is Democratic Representative Jerry Nadler, naming the bipartisanship of this effort and explicitly linking terrorism and immigration. 

Then-United States Representative Jerry Nadler: Because although we shared the goal of opposing terrorism, we shared the goal of stopping fundraising for terrorist organizations such as Hamas or Hezbollah in the United States. We shared the goal of expeditiously deporting aliens engaged in terrorism.

Maren: Despite the fact that Congress introduced this bill after the Oklahoma City bombing — an attack far more deadly than the World Trade Center bombing, and an attack carried out by a far-right violent extremist — members of Congress keep talking about immigration, and not far-right violent extremism, as the threat.

[Music in.]

Maren: Here’s César again. 

César Cuauhtémoc García Hernández: Um, and eventually in 1996, the Congress sent to President Clinton the Antiterrorism and Effective Death Penalty Act, which certainly targets, targets terrorist activity, makes it easier, for example, to wind up in with capital punishment and, in the federal system as a result of such activities. But it also devotes an enormous amount of, of its text, um, to targeting migrants and changing immigration law.

Maren: It authorized 20 million dollars to detain and deport migrants for the next four years. 

César Cuauhtémoc García Hernández:Fundamentally, it’s this idea that so many migrants are coming here with the goal of harming. Those of us who are already here. Crafting this really clear division between us and them.

Maren: There is a score of laws that were passed in the ’80s and ’90s that really amplify the government’s power to not just deport, but detain people who are here illegally. Some of these laws were a result of the war on drugs, which disproportionately targeted and detained young people of color in unprecedented amounts. But this law seemed different because of the way it linked terrorism and immigration detention.

In 1996, the average daily immigrant detention population was just over 9,000. After these laws were passed and implemented, the number began to creep up. And then came the deadliest attack on U.S. soil.

César Cuauhtémoc García Hernández:What we then see an a, a much more sizable increase in the number of migrants who are detained in the aftermath of the attacks of September 11th, 2001. And we haven’t really turned back. 

Maren: And by the time that Immigration and Customs Enforcement was created in 2003 under the Department of Homeland Security, the number of migrants held in detention had more than doubled. At one point in 2019, before the COVID-19 pandemic forced ICE to release many people due to the serious health risks of being detained in close quarters, the daily population was 55,000. That’s roughly the population of Youngstown, Ohio. Seventy percent had no criminal convictions. As of recording this podcast, there are more than 34,000people being detained.

Maren: Over 2.4 million people were apprehended at the southern border in fiscal year 2023 alone, and there are over 1 million asylum cases waiting to be processed. When people enter the U.S. illegally and are identified by DHS, they are often held in custody while it’s determined whether or not they’re a risk to the public. Sometimes that can take days, sometimes months, and sometimes years. 

Texas holds the most people in ICE detention of any other state. More than a third of people in ICE detention are in facilities in Texas.

Maren: It’s early evening, and I’m at a migrant shelter in El Paso, Texas, with Crystal Sandoval, an advocate and the director of cross-border strategies for the nonprofit Las Americas. Crystal said these migrant shelters, usually run by churches and non-profit organizations, are sometimes the only options migrants have after they’ve been released from ICE detention. The shelters provide supplies and meals in addition to a place to sleep. Some nonprofits like Las Americas, Crystal’s organization, will visit these shelters a couple times a week to offer education and assistance on navigating the U.S. immigration system. 

Crystal told me that she alone helps more than 2,000 people a month. I’m with her on one of her visits, where she explains the next steps to people after they’ve been released from ICE detention. I’m trying to get a better idea of who is crossing the border and who ends up in ICE detention. She brought me here to speak with people about their experiences.

Maren: The shelter takes up a block. On either side of the lot, two big buildings where people sleep, one for men and one for women. In the middle is a large open concrete parking area.

A couple little kids are racing around me on bikes. They’re screaming and laughing. Families are standing around watching their kids play. People are filtering in and out of the dorms.

Crystal tells me that if we wait in the concrete lot, people will just come up to us and she’ll help me ask about their experiences.

As predicted, the moment Crystal sets down her bag and pulls out her notebook, 

people spot her. They come up and ask her questions, like “What’s the next step for my case?” She’s holding up a blank asylum application, explaining to the group how to fill it out. 

At one point, she grabs her notepad and starts writing out the names of immigration offices —ICE, CBP, USCIS — to explain how the immigration system works.

She has to break tough news to them — that they can’t start applying for jobs right away, and the path to citizenship isn’t an easy one in the U.S. 

For the next two hours, Crystal fields questions five at a time.

I have to fend for myself, so, I make friends with a shelter coordinator, Joseph. He thinks of a few people who I could speak to. One of them is Oderwuil Esteban Marval Rivas.

Joseph Olivas: This is my friend. He says he’ll do the interview.

Maren: Oderwuil told me that he’s 24 and from Venezuela, and is staying at the shelter. He’s been through a lot. He’s one of the first people to tell me about his experience in ICE detention.

Maren: He’s saying, “Well, at the beginning it was stressful, sad, painful because you’re alone and they also denigrate you because of your race. And well, they didn’t mistreat us, but they didn’t treat us well either.

 “They punished us. They put us in a place they call the hole.

[Music in.]

“It was crazy in the hole. They took me to the bathroom handcuffed. They took me to the yard handcuffed. They would wake me up every 20 minutes to check if I was doing okay. It was tormenting.” 

Maren: This is Diego Andrés, another person I met who had been in ICE detention.

Diego is saying, “They truly treat you badly in there. They denigrate you a little bit. 

“They treat you like a prisoner, like a criminal. They scream at you. And if, for instance, something’s happening and an officer disrespects you, you cannot defend yourself. You can’t say anything.

“If you did, they send you to the hole for 15 days, which is like a room — four walls and you’re there alone.

”Sometimes they treated you badly over there. They talked to you with insults. They told you things like that. And if you tried to stand up for yourself, sometimes, you would get into fights with them. And sometimes they would handcuff you and put you in there, in what they call ‘the hole.’”

Maren: Both Oderwuil and Diego mention solitary confinement, they mention disrespect and racism. Individual stories like these can give you pause, because they are very troubling, but also it’s hard to substantiate these stories or know if they are emblematic of a larger problem.

POGO Senior Investigator Nick Schwellenbach: One of the key things we did for this story is we filed a Freedom of Information Act request. 

Maren: Guess who’s back? It’s your favorite POGO investigator, Nick Schwellenbach. As a seasoned journalist, Nick uncovers information in all sorts of ways, but one of the most critical is the Freedom of Information Act, or FOIA. FOIA is a law that allows reporters and the public to request information from the federal government. We’ll be getting much deeper into this later, like so much deeper that you’ll be annoyed — not at me; at the federal government. But for now, know that this tool is powerful, and it’s one of the few ways we as journalist can pull back the curtain on what’s happening inside the federal government. Anyways, back to Nick. 

Nick Schwellenbach: We had read a watchdog report from the Department of Homeland Security that referred to sort of these data sets, and this data was supposed to track the use of solitary confinement inside of ICE detention facilities.

Maren: Solitary confinement is when people being detained are isolated in a cell, away from the general population for up to 23 hours a day. Nick and his POGO colleagues filed a FOIA for this data and got it back seven months later. 

Nick Schwellenbach: We got these, you know, spreadsheets that you can open up in Excel. Sort of the official, uh, term of art is segregation. And by the use of segregation, they mean segregating you from the general population. And there are different variations of segregation. Um, there’s administrative segregation, there’s disciplinary segregation, there’s medical isolation. So, these are all sort of euphemisms for basically isolating you. And it’s not always used as sort of a negative tool, but sometimes segregation is used to punish people.

Nick Schwellenbach: People have said that they’ve been threatened with being put into solitary confinement if they’ve refused to do work, which is only supposed to be voluntary. 

Maren: The data POGO obtained via FOIA captured over 6,500 instances of solitary confinement in ICE detention centers from January 2016 to May of 2018. 

Nick Schwellenbach: A large number of people who are put into segregation or solitary confinement or whatever your preferred term is are kept there for extraordinarily long periods of time. 

Maren: While experts say that “prolonged solitary confinement” is when someone is isolated for more than 15 consecutive days, the data POGO obtained showed that in more than 60% of instances of solitary confinement, the isolation lasted for more than 15 days. Records show some people were isolated for months, and in some cases for more than a year. One person was held in solitary for more than two years. 

Nick Schwellenbach: And not only that, a very large percentage of people put into solitary confinement, regardless of the length of time, but including in very prolonged periods of time have, you know, identified cases of, of, of mental health issues. The problem with segregation or solitary confinement is even short-term use of solitary confinement can cause or exacerbate mental health issues. And there have been cases in ice detention facilities where people with documented mental health issues have ended up committing suicide, um, in ICE detention after being kept in segregation or even in segregation.

Maren: Nick found that 2,579 people with mental illness were put in solitary, and nearly a thousand of those individuals were kept there for more than 15 days. 

There was one ICE facility that stood out among the rest. 

Nick Schwellenbach: The biggest user of solitary confinement, Adelanto in California. Some facilities use disciplinary segregation quite a bit. Um, some use it as essentially their go- to for isolating people who have mental health issues. And that seems to be what we saw at  Adelanto.

Maren: In 2019, Adelanto ICE Processing Center was one of the largest ICE detention facilities in the country, and at one point the average daily population was more than 1,700 

Nick Schwellenbach: We found that they kept fairly large percentages of people in solitary confinement for very long periods of time.

Maren: According to POGO’s investigation, Adelanto accounted for the majority of the records of solitary. Adelanto also reported more detainees held for longer than 75 days than any other ICE detention facility. That’s five times longer than U.N. experts recommend as the maximum time for isolation. Some of the people confined for prolonged periods also had severe mental illnesses. Two-thirds of Adelanto’s reports from January 2016 to May of 2018 indicate that the detainees being isolated have a mental illness. ICE has not responded to POGO’s request for comment. 

As Nick is reporting out this investigation into the use of solitary confinement at ICE facilities, he gets a tip — and it’s about Adelanto. 

Nick Schwellenbach: So we had a tipster inside of the Department of Homeland Security. The tipster came in, uh, while we were still working on the, the first investigation.

The tipster said that experts had extraordinarily damning findings uh, when they went in and looked at the use of solitary by Adelanto, which, you know, obviously piqued my interest and I promptly filed a Freedom of Information Act request for this and other similar uh, site visits by experts.

Maren: And there’s something else about Adelanto. It’s not just any facility. It’s the ICE facility Berto ends up at.

Berto Hernandez: From when I got put into that van until like I got to Adelanto, like I just, just sobbing and crying and thinking like, like what am I going to do now?

Berto Hernandez: Getting to Adelanto, I remember how cold it was, like, super, super cold. I just felt so dehumanized.

Maren: And Nick gets the Adelanto reports.

Y eso fue lo único que recuerdo que mi tía siempre decía: “nunca firmes nada”. Y en medio de ese momento de pánico, ansiedad y miedo, lo recuerdo. Y creo que, en realidad, esa fue una de las cosas que de hecho me mantuvieron aquí. 

Maren: Primero, le llevaron a un centro en San Bernardino. 

Berto Hernandez: Me aislaron de todos y luego pude hablar con el oficial que me agredió. 

Y él dijo: "Oh, lamento haber tenido que hacer eso". Y yo dije: "O sea, ¿en serio?" Y luego puso este formulario frente a mí. Él dice, "pero si firmas aquí, puedes estar en México, hoy, esta noche". 

Entonces estaba tratando de entender lo que estaba sucediendo. 

Maren: Le preguntamos a Berto si alguna vez presentó una denuncia contra el oficial, pero dijo que no, porque estaba en un estado de extrema angustia. Berto dijo que este oficial le dijo que si no firmaba los papeles, terminaría en una instalación de ICE y tendría que presentarse ante un juez. 

Berto Hernandez: Y yo dije: “Sí, quiero ver a un juez. No te conozco. No sé cuáles son tus intenciones”. 

Maren: Alrededor de las 5 p.m., Berto dijo que le transportaron a un centro de detención de inmigrantes. 

Berto Hernandez: Me encadenaron de las muñecas a la cintura. Y luego me encadenaron los pies, de los tobillos hasta la cintura para que no pudiera moverme. 

Incluso caminar era muy, muy difícil. Y solo recuerdo sentirme tan impotente.

Profesor y autor César Cuauhtémoc García Hernández: Tan pronto como el gobierno federal comenzó a decidir que algunas personas debían permanecer fuera de los Estados Unidos y a otras se les podía permitir la entrada a los Estados Unidos, tuvimos que descubrir quién encaja en cada una de estas categorías. 

Maren: Este es César Cuauhtémoc García Hernández. Es profesor de derecho en la Universidad Estatal de Ohio y autor de varios libros sobre leyes de inmigración, incluido uno centrado principalmente en la detención. Me está ayudando a comprender el contexto de cómo surgieron los centros de detención de ICE y se convirtieron en una parte integral de la misión del Departamento de Seguridad Nacional. 

La detención de inmigrantes es algo relativamente nuevo en la historia de nuestra nación y ha evolucionado a lo largo de los años. Ha existido desde finales del siglo XIX, cuando el Congreso aprobó la Ley de Exclusión China de 1882. 

César Cuauhtémoc García Hernández: Los chinos, eh, los posibles inmigrantes eran literalmente retenidos en barcos y los inspectores, funcionarios de aduanas, intentarían, subían a bordo y trataban de averiguar: “Está bien, ¿te dejaremos desembarcar o no? " Las compañías navieras finalmente negociaron un acuerdo por el cual alojarían a estas personas en tierra y ese es esencialmente el primer centro de detención de inmigrantes en tierra. 

Lugares como Ellis Island, famoso por ser el sitio de bienvenida para generaciones de recién llegados. Y ciertamente fue eso, pero también fue una de las primeras cárceles de inmigrantes en la historia de Estados Unidos. 

Maren: César dice que el uso de la detención de inmigrantes comenzó a disminuir a mediados del siglo XX, pero luego volvió a aumentar con la guerra contra las drogas en los años 80 y 90 y se disparó después de la formación del DHS. 

Para entender cómo la inmigración quedó tan envuelta por las amenazas terroristas en Estados Unidos y cómo la detención se convirtió en parte integral del sistema de inmigración, necesitamos repasar dos acontecimientos importantes de los años 90: los bombazos en el World Trade Center y en Oklahoma City. Hemos hablado previamente del atentado de Oklahoma City, pero esta vez vamos a analizar un poco más de cerca cómo moldeó la conversación sobre el terrorismo actual. 

El 26 de febrero de 1993 se produjo un atentado contra el World Trade Center, que dejó seis personas muertas y más de mil heridas. 

Presentador de WKYC: Es oficial. Una bomba provocó la mortal explosión en el World Trade Center. El World Trade Center estará cerrado durante al menos una semana, y la investigación sobre quién colocó la bomba y por qué podría tomar de dos a tres meses. 

Maren: El grupo de hombres condenados posteriormente por el ataque terrorista eran inmigrantes. Y Ramzi Yousef, quien más tarde fue considerado el organizador y cerebro detrás del ataque, había pedido asilo cuando llegó aquí en 1992. Como resultado, en las discusiones sobre cómo prevenir otro ataque terrorista, la inmigración fue tema central. 

Then-Representative Chuck Schumer (D-NY): Debemos considerar el terrorismo en el World Trade Center como una llamada de atención, como un cañonazo que nos insta a actuar. 

Maren: Este es el entonces representante Chuck Schumer, cuando era representante federal de un distrito en Brooklyn en la ciudad de Nueva York. Aquí preside el Subcomité Judicial de la Cámara de Representantes sobre Delincuencia y Justicia Penal. Y el subcomité está celebrando una audiencia sobre la investigación del atentado contra el World Trade Center poco más de una semana después del ataque. 

Chuck Schumer: Estamos justificadamente orgullosos de nuestra sociedad libre y abierta. No queremos cerrar fronteras ni establecer medidas de seguridad severas en cada esquina de nuestra sociedad. Pero seguramente hay pasos entre un Estado seguro pero completamente cerrado y una sociedad totalmente abierta pero peligrosamente vulnerable. 

Maren: Y unos meses después del ataque, el Subcomité Judicial del Senado para Inmigración y Asuntos de Refugiados celebró una audiencia sobre la política de inmigración de Estados Unidos, indicando que el atentado al World Trade Center fue un caso en el que los terroristas abusaron del sistema de inmigración de Estados Unidos. Aquí tenemos al entonces senador Ted Kennedy. 

Senador de los Estados Unidos Edward Kennedy (D-MA): Nuestras leyes y procedimientos de inmigración están siendo abrumados por los solicitantes de asilo, muchos de los cuales hacen solicitudes fraudulentas y algunos de los cuales son terroristas. 

Maren: Aquí está el entonces presidente Bill Clinton en enero de 1995, dando su discurso sobre el Estado de la Unión. 

El entonces presidente Bill Clinton: Todos los estadounidenses, no sólo en los estados más afectados, sino en todos los lugares del país, están con justa razón preocupados por el gran número de extranjeros ilegales que ingresan a nuestro país. Es por eso que nuestra administración ha tomado medidas agresivas para reforzar la seguridad de nuestras fronteras contratando un número récord de guardias fronterizos nuevos.  

Maren: Menos de tres meses después de ese discurso, estalló otra bomba, pero esta vez fue un ataque terrorista por parte de un violento extremista de extrema derecha. 

NBC anchor: Un enorme coche bomba explotó frente a un edificio federal grande en el centro de Oklahoma City. Destruyó el edificio, mató niños, mató a empleados federales, militares y civiles. 

Maren: Dos años después del atentado contra el World Trade Center, el 19 de abril de 1995, se produjo otro atentado contra un edificio federal en Oklahoma City, que mató a 168 personas, entre ellas 19 niños. César dice que el estatus migratorio del terrorista del World Trade Center, Ramzi Yousef, influyó en la discusión sobre quién podría ser responsable de este ataque aún más mortífero. 

César Cuauhtémoc García Hernández: Después del horrible bombazo contra el edificio federal en la ciudad de Oklahoma, los políticos inmediatamente se aferraron a la idea de que esto debía haber sido perpetrado por extranjeros, por inmigrantes. Resulta que eso era todo menos la verdad. 

Maren: Timothy McVeigh, un veterano con conexiones con el KKK, estuvo detrás del ataque terrorista. Las investigaciones muestran que McVeigh en un momento se convirtió en miembro del KKK y personas de su pasado dijeron que era racista. 

NBC anchor: Fue el acto terrorista más grave en la historia de Estados Unidos y Timothy McVeigh ahora podría ser condenado a muerte. 

Maren: En mayo de 2001, mientras estaba en el corredor de la muerte, McVeigh hizo públicas las cartas que escribió describiendo sus motivos. Según el periodista con el que compartió las cartas, menciona eventos en los que redadas de las fuerzas policiales federales terminaron violentamente, como la de Waco, que fue casi exactamente dos años antes, como inspiración para el ataque. Recuerden, en el último episodio expliqué cómo el extremismo antigubernamental así como el extremismo supremacista blanco caben bajo el paraguas del extremismo de extrema derecha. 

César Cuauhtémoc García Hernández: Estos fueron hombres blancos nacidos aquí que perpetraron esta matanza masiva. Y, sin embargo, la realidad de ese trágico suceso en Oklahoma City no hizo nada para alterar la trayectoria política en la que ya se encontraba el país, y que este suceso simplemente impulsó aún más.

Maren: En respuesta al atentado de Oklahoma City, se presenta un proyecto de ley bipartidista. Es la Ley Antiterrorista y de Pena de Muerte Efectiva de 1996. Y pueden escuchar una y otra vez que a pesar de que el terrorista era ciudadano estadounidense, los miembros del Congreso están argumentando que esta ley antiterrorista debe incluir reformas migratorias también. Aquí tenemos al entonces representante republicano Bill McCollum. 

El entonces representante de los Estados Unidos, Bill McCollum (R-FL): A menudo, descubrimos que los terroristas, o los potenciales terroristas, son extranjeros criminales y no los estamos deportando de manera adecuada. Necesitamos expulsar a estas personas del país y contar con los procedimientos para hacerlo. 

Maren: Y aquí tenemos al representante demócrata Jerry Nadler, mencionando el bipartidismo de este esfuerzo y vinculando explícitamente el terrorismo con la inmigración. 

El entonces representante de los Estados Unidos, Jerry Nadler: Porque si bien compartimos el objetivo de oponernos al terrorismo, compartimos el objetivo de detener la recaudación de fondos para organizaciones terroristas como Hamás o Hezbolá en los Estados Unidos. Compartimos el objetivo de deportar rápidamente a los extranjeros involucrados en el terrorismo.

Maren: A pesar de que el Congreso presentó este proyecto de ley después del atentado de Oklahoma City (un ataque mucho más mortífero que el del World Trade Center y llevado a cabo por un extremista violento de extrema derecha), los miembros del Congreso siguen hablando de inmigración, y no del extremismo violento de derecha, como amenaza. 

[Entra música.] 

Maren: Aquí está César otra vez.  

César Cuauhtémoc García Hernández: Um, y finalmente en 1996, el Congreso envió al Presidente Clinton la la Ley Antiterrorista y de Pena de Muerte Efectiva, que ciertamente se enfoca en la actividad terrorista, hace que sea más fácil, por ejemplo, recibir la pena capital en el sistema federal como como resultado de tales actividades. Pero también dedica una enorme cantidad de su texto a atacar a los inmigrantes y cambiar las leyes de inmigración. 

[Entra música.] 

Maren: Autorizaba el gasto de 20 millones de dólares para detener y deportar a migrantes durante los siguientes cuatro años. 

César Cuauhtémoc García Hernández: Fundamentalmente, se trata de esta idea de que muchos inmigrantes vienen aquí con el objetivo de hacer daño. A los que ya estamos aquí. Creando esta división realmente clara entre nosotros y ellos. 

Maren: Hay una serie de leyes que se aprobaron en los años 80 y 90 que realmente amplifican el poder del gobierno no sólo para deportar, sino también para detener a personas que se encuentran aquí ilegalmente. Algunas de estas leyes fueron el resultado de la guerra contra las drogas, por la cual se atacó y detuvo de manera desproporcionada a jóvenes de color en cantidades sin precedentes. Pero esta ley parecía diferente por la forma en que vinculaba el terrorismo y la detención de inmigrantes. 

En 1996, el promedio diario de población inmigrante detenida era de poco más de 9.000 personas. Después de que se aprobaron e implementaron estas leyes, el número comenzó a subir. Y luego vino el ataque más letal en suelo estadounidense. 

César Cuauhtémoc García Hernández: Lo que entonces vemos es un aumento mucho más considerable en el número de inmigrantes detenidos tras los ataques del 11 de septiembre de 2001. Y realmente no hemos dado marcha atrás. 

Maren: Y para cuando se creó el Servicio de Inmigración y Control de Aduanas en 2003, bajo la tutela del Departamento de Seguridad Nacional, el número de inmigrantes detenidos se había más que duplicado. En un momento de 2019, antes de que la pandemia de COVID-19 obligara a ICE a liberar a muchas personas debido a los graves riesgos para la salud que implicaba tener detenidos en espacios reducidos, la población diaria era de 55.000. Esa es aproximadamente la población de Youngstown, Ohio. El 70 por ciento no tenía condenas penales. Al momento de grabar este podcast, hay más de 34.000 personas detenidas.

Maren: Más de 2,4 millones de personas fueron detenidas en la frontera sur solo en el año fiscal 2023, y hay más de 1 millón de casos de asilo esperando ser procesados. Cuando las personas ingresan ilegalmente a los EE. UU. y son identificadas por el DHS, a menudo son detenidas mientras se determina si representan o no un riesgo para el público. A veces eso puede llevar días, a veces meses y a veces años. 

Texas tiene la mayor cantidad de personas detenidas por ICE que cualquier otro estado. Más de un tercio de las personas detenidas por ICE se encuentran en instalaciones en Texas.

Maren: Es temprano en la tarde y estoy en un refugio para migrantes en El Paso, Texas, con Crystal Sandoval, defensora y directora de estrategias transfronterizas de la organización sin fines de lucro Las Américas. Crystal dijo que estos refugios para migrantes, generalmente administrados por iglesias y organizaciones sin fines de lucro, son a veces las únicas opciones que los migrantes tienen después de que ICE los libera de su custodia. Los refugios proporcionan suministros y comidas además de un lugar para dormir. Algunas organizaciones sin fines de lucro como Las Américas, la organización de Crystal, visitan estos refugios un par de veces por semana para ofrecer educación y asistencia sobre cómo navegar el sistema de inmigración de Estados Unidos. 

Crystal me dijo que ella sola ayuda a más de 2000 personas al mes. La acompaño en una de sus visitas, donde explica los pasos a seguir a las personas después de que han sido liberadas de la detención de ICE. Estoy tratando de entender mejor quién cruza la frontera y quién termina detenido por ICE. Ella me trajo aquí para hablar con la gente sobre sus experiencias. 

Maren: El refugio abarca toda una manzana. A cada lado del terreno, dos grandes edificios donde duerme la gente, uno para hombres y otro para mujeres. En medio hay una estacionamiento grande de concreto.  

Un par de niños pequeños andan a toda velocidad en bicicletas a mi alrededor. Gritan y ríen. Las familias están de pie viendo jugar a sus hijos. La gente entra y sale de los dormitorios. 

Crystal me dice que si esperamos en el estacionamiento de concreto, la gente simplemente se acercará a nosotros y ella me ayudará a preguntarles sobre sus experiencias.

Como predicho, en el momento en que Crystal deja su bolso y saca su cuaderno, la gente la nota. {Graph broken in original} 

Se acercan y le hacen preguntas como "¿Cuál es el siguiente paso en mi caso?" Ella sostiene una solicitud de asilo en blanco y le explica al grupo cómo completarla. 

En un momento dado, ella toma su libreta y comienza a escribir los nombres de las agencias de inmigración (ICE, CBP, USCIS) para explicar cómo funciona el sistema de inmigración. 

Tiene que darles noticias difíciles: que no pueden empezar a solicitar empleo de inmediato y que el camino hacia la ciudadanía no es nada fácil en Estados Unidos. 

Durante las siguientes dos horas, Crystal responde cinco preguntas a la vez. 

Tengo que valerme por mí misma, así que me hago amiga del coordinador del refugio, Joseph. Él piensa en algunas personas con las que podría hablar. Uno de ellos es Oderwuil Esteban Marval Rivas. 

Joseph Olivas: Este es mi amigo. Dice que está de acuerdo con que lo entrevistes. 

Maren: Oderwuil me dijo que tiene 24 años, es venezolano y se queda en el refugio. Ha pasado por mucho. Es una de las primeras personas en contarme acerca de su experiencia en la custodia de ICE. 

[Oderwuil habla español y Joseph interpreta]

Maren: Él dice: “Bueno, al principio fue estresante, triste, doloroso porque estás solo y también te denigran por tu raza. Y bueno, no nos maltrataron, pero tampoco nos trataron bien.” 

“Nos castigaban. Nos metían en un lugar al que llaman el hoyo.” 

[Entra música.] 

[Diego Andrés hablando español.] 

“Era algo de locos en el hoyo. Me llevaban al baño esposado. A la yarda me llevaban esposado. Me levantaban a cada 20 minutos para saber si estaba bien o vivo. Era tormentoso eso”. 

Maren: Este es Diego Andrés, otra persona que conocí que había estado bajo custodia de ICE. 

Diego cuenta, “La verdad que si te tratan mal allá adentro. Si te tratan, te denigran un poquito”. 

“Te quieren tratar como un prisionero, como un delincuente. Te gritan. Y si, por ejemplo, si está pasando algo y un oficial te falta al respeto, tú no te puedes defender. No le puedes decir nada”.  

“Si no, te metían 15 días en un hueco, o sea como un cuarto, cuatro paredes tú solo”.  
“Había veces que te trataban mal, que te hablaban con groserías. Te decían cosas así. Y uno por querer darse a respetar, a veces, tú peleabas con ellos, pues. En veces te esposaban y te metían para allá, para como le dicen el hueco”.

Maren: Tanto Oderwuil como Diego mencionan el confinamiento solitario, mencionan la falta de respeto y el racismo. Historias individuales como estas te pueden hacer pensar, porque son muy preocupantes, pero también es difícil fundamentarlas o saber si son emblemáticas de un problema mayor.

Nick Schwellenbach, investigador principal del PDSG: Una de las cosas clave que hicimos para esta historia fue presentar una solicitud bajo la Ley de Libertad de Información. 

Maren: ¿Adivinen quién está de vuelta? Es su investigador del PDSG favorito, Nick Schwellenbach. Como periodista experimentado, Nick descubre información de muchas maneras, pero una de las más importantes es la Ley de Libertad de Información o FOIA. FOIA es una ley que permite a los periodistas y al público solicitar información al gobierno federal. Profundizaremos mucho más en esto más adelante, tanto que se molestarán, no conmigo; sino con el gobierno federal. Pero por ahora, sepan que esta herramienta es poderosa y es una de las pocas formas en que nosotros, como periodistas, podemos revelar lo que está sucediendo dentro del gobierno federal. En todo caso, volvamos con Nick. 

Nick Schwellenbach: Habíamos leído un informe de supervisión del Departamento de Seguridad Nacional que se refería a unos conjuntos de datos, y se suponía que estos datos rastreaban el uso del confinamiento solitario dentro de los centros de detención de ICE. 

Maren: El confinamiento solitario consiste en aislar a las personas detenidas en una celda, alejadas de la población general, por hasta 23 horas al día. Nick y sus colegas de PDSG  presentaron una solicitud FOIA para obtener estos datos que se les entregaron siete meses después. 

Nick Schwellenbach: Tenemos estas, ya tú sabes, hojas de cálculo que puedes abrir en Excel. El término técnico oficial es, pues, segregación. Y al hablar de segregación, se refieren a segregarte de la población general. Y hay diferentes tipos de segregación. Um, hay segregación administrativa, hay segregación disciplinaria, hay aislamiento médico. Entonces, estos son  solo eufemismos para lo que simplemente es aislamiento. Y no siempre se utiliza como una especie de herramienta negativa, pero a veces la segregación se utiliza para castigar a las personas.

Nick Schwellenbach: Algunas personas han dicho que las han amenazado con ponerlas en confinamiento solitario si se niegan a trabajar, algo que se supone es voluntario. 

Maren: Los datos que PDSG obtuvo a través de la solicitud FOIA registraron más de 6.500 casos de confinamiento solitario en los centros de detención de ICE desde enero de 2016 hasta mayo de 2018. 

Nick Schwellenbach: A un gran número de personas puestas en segregación o confinamiento solitario o como prefieras llamarlo se les mantiene allí durante períodos de tiempo extraordinariamente largos.  

Maren: Si bien los expertos dicen que el “confinamiento solitario prolongado” es cuando alguien está aislado durante más de 15 días consecutivos, los datos obtenidos por PDSG mostraron que en más del 60% de los casos de confinamiento solitario, el aislamiento duró más de 15 días. Los documentos muestran que algunas personas estuvieron aisladas durante meses y, en algunos casos, durante más de un año. Una persona estuvo confinada en solitario durante más de dos años. 

Nick Schwellenbach: Y no solo eso, a un porcentaje muy grande de personas puestas en confinamiento solitario, independientemente de la duración, pero incluso en períodos de tiempo muy prolongados, se la ha identificado casos de problemas de salud mental. El problema con la segregación o el confinamiento solitario es que incluso el uso a corto plazo de este  confinamiento puede causar o exacerbar problemas de salud mental. Y ha habido casos en centros de detención de ICE donde personas con problemas de salud mental documentados terminaron suicidándose, um, bajo custodia de ICE después de haber sido mantenidas en segregación o incluso en segregación. 

Maren: Nick descubrió que 2.579 personas con enfermedades mentales fueron puestas en confinamiento solitario, y casi mil de esas personas permanecieron allí durante más de 15 días. 

Una instalación de ICE se destacó entre las demás. 

Nick Schwellenbach: El mayor usuario del régimen de aislamiento: Adelanto, en California. Algunos centros utilizan bastante la segregación disciplinaria. Algunos lo usan esencialmente como su solución para aislar a las personas que tienen problemas de salud mental. Y eso parece ser lo que vimos en Adelanto.

Maren: En 2019, el Centro de Procesamiento de ICE de Adelanto era uno de los centros de detención de ICE más grandes del país, y en un momento la población diaria promedio era de más de 1,700. 

Nick Schwellenbach: Descubrimos que mantenían a porcentajes bastante grandes de personas en confinamiento solitario durante períodos de tiempo muy largos. 

Maren: Según la investigación del PDSG, Adelanto representaba la mayoría de los casos de aislamiento. Adelanto también reportó el mayor número de detenidos retenidos por más de 75 días que cualquier otro centro de detención de ICE. Eso es cinco veces más de lo que los expertos de la ONU recomiendan como tiempo máximo de aislamiento. Algunas de las personas recluidas durante períodos prolongados también padecían enfermedades mentales graves. Dos tercios de los informes de Adelanto de enero de 2016 a mayo de 2018 indican que los detenidos en aislamiento tienen una enfermedad mental. ICE no ha respondido a la solicitud de comentarios del PDSG. 

Mientras Nick trabaja en esta investigación sobre el uso del confinamiento solitario en las instalaciones de ICE, recibe una pista, y es acerca de Adelanto. 

Nick Schwellenbach: Teníamos un informante dentro del Departamento de Seguridad Nacional. El informante apareció mientras todavía estábamos trabajando en la primera investigación. 

El informante dijo que los expertos realizaron hallazgos extraordinariamente condenatorios, cuando visitaron y analizaron el uso del confinamiento solitario por parte de Adelanto, lo cual, ya tú sabes, obviamente despertó mi interés y rápidamente presenté una solicitud información bajo la Ley de Libertad de Información para esta y otras visitas similares por parte de expertos. 

Maren: Y hay algo más sobre Adelanto. No es una instalación cualquiera. Es la instalación de ICE donde Berto acaba.

Berto Hernandez: Desde que me subieron a esa camioneta hasta que llegué a Adelanto, simplemente sollocé y lloré y pensé: ¿qué voy a hacer ahora?
